973059320Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 10.01 of Title 2.1 a section numbered 2.1-116.014 as follows:
§ 2.1-116.014. Notice of charges absent a grievance procedure for deputy sheriffs.
If a formal grievance procedure is not available pursuant to § 2.1-116.012, before a deputy sheriff is dismissed, demoted, suspended without pay, or transferred for punitive reasons, the sheriff shall give the deputy (i) notice in writing of all charges, the bases therefor, and the action proposed and (ii) an opportunity, within a reasonable time after the date of the written notice, to respond to the charges orally and in writing. The time allowed for response shall be determined by the sheriff, but in no event shall it be less than five calendar days unless agreed to by the deputy.
