VIRGINIA ACTS OF ASSEMBLY -- CHAPTER An Act for the relief of Sunway Electrical Contractors, Inc. [H 1895] Approved

Whereas, Victor R. Hewett is the president of Sunway Electrical Contractors, Inc.; and

Whereas, Victor R. Hewett and his wife, Patricia, are the sole shareholders of Sunway; and

Whereas, in 1991, upon the formation of Sunway, the Department of Taxation gave Mr. Hewett a coupon book to use in making sales tax payments; and

Whereas, Sunway paid $32,036.70 in sales tax between 1991 and 1994; and

Whereas, on February 6, 1996, the Department of Taxation advised Mr. Hewett that Sunway was not and never should have been required to make sales tax payments; and

Whereas, the Department of Taxation refunded to Sunway the amount of $11,645.75; and

Whereas, based on the expiration of the statute of limitations, the Department of Taxation did not refund $20,390.95 to Sunway; and

Whereas, Sunway has no other means of obtaining relief except by action of this body; now, therefore,

Be it enacted by the General Assembly of Virginia:

1. § 1. That there is hereby appropriated from the general fund of the state treasury the sum of $20,390.95 for the relief of Sunway Electrical Contractors, Inc. This sum shall be paid by check issued by the State Treasurer on a warrant issued by the Comptroller, upon execution by Victor R. Hewett and Patricia Hewett of a release of all claims that they and Sunway Electrical Contractors, Inc., may have against the Commonwealth or any of its political subdivisions or their officers, employees, or agents.
