VIRGINIA ACTS OF ASSEMBLY -- CHAPTER
An Act to amend and reenact §§ 5 and 32 as amended of Chapter 393 of the Acts of Assembly of 1932, which provided a charter for the City of Williamsburg, relating to the sheriff.

Be it enacted by the General Assembly of Virginia:

1. That §§ 5 and 32 as amended of Chapter 393 of the Acts of Assembly of 1932 are amended and reenacted as follows:

§ 5. The municipal officers of said city shall consist of a city sheriff and a commissioner of the revenue, elected by the qualified voters of said city, five councilmen, elected as provided in § 13 8 of this charter, and a sheriff, a treasurer, an attorney for the Commonwealth, and a clerk of the Circuit Court of the City of Williamsburg and of the County of James City, elected conjointly for the City of Williamsburg and the County of James City, by the voters of the said county and city, and such additional officers as are herein provided for or may be provided for by the council. Each city councilman shall be elected on the first Tuesday in May preceding the expiration of the term of office of the incumbent councilman or councilmen whose term is expiring. Councilmen shall serve for such terms as are prescribed in this charter. All other city officers required by the laws of the Commonwealth to be elected by the qualified voters of the city shall be elected on the first Tuesday following the first Monday in November preceding the expiration of the terms of office of the respective incumbents, for such terms as are prescribed by law. All such elected officers shall be nominated and elected as provided in the general laws of the Commonwealth. The officers so elected or appointed shall continue in office until their successors are elected and qualified.

§ 32. The city sheriff of the city shall have the powers of the police force of the said city, and shall have charge of the city jail. In addition, the city sheriff shall have all powers granted to sheriffs, under the Constitution and general laws of the Commonwealth of Virginia. The city sheriff and policemen police, in criminal and police matters, shall have jurisdiction for one mile from the corporate limits of the said city.

2. That, beginning January 1, 1998, the sheriff for James City County shall serve as sheriff for both James City County and the City of Williamsburg until the expiration of such sheriff's term on January 1, 2000, and that beginning with the general election in November 1999, and every four years thereafter, the voters of James City County and the City of Williamsburg shall jointly elect a sheriff to serve both localities.

3. That, until January 1, 1998, the organization and powers of the respective sheriffs' offices shall continue under the provisions existing prior to the effective date of this act.
