Whereas, Mr. and Mrs. Nunley purchased two lots in Frederick County in the late 1950's; and

Whereas, the Wilde Acres Property Owner's Association, Inc., was formed in the 1960's; and

Whereas, Mr. and Mrs. Nunley participated in the Homeowner's Association and paid dues to the Association; and

Whereas, Mr. Nunley died in 1989 and Mrs. Nunley desired to sell the lots; and

Whereas, state law in 1989 required far more stringent environmental testing than was required in the late 1950's; and

Whereas, it was determined that the property does not "perk" and is therefore worthless; and

Whereas, the Homeowner's Association is taking legal action against Mrs. Nunley to collect dues on the worthless property; and

Whereas, Mrs. Nunley has no other means to obtain relief except by action of this body; now therefore,

Be it enacted by the General Assembly of Virginia:

1. § 1. That there is hereby appropriated from the general fund of the State Treasury the sum of $3,000 for the relief of Betty L. Nunley to be paid by check issued by the State Treasurer on warrant of the Comptroller to Betty L. Nunley, upon execution by her of a release of all claims she may have against the Commonwealth or of any agency, instrumentality, officer, employee or political subdivision thereof, in connection with the aforesaid occurrence.
