Be it enacted by the General Assembly of Virginia:

1. That § 46.2-917 of the Code of Virginia is amended and reenacted as follows:

§ 46.2-917. Operation of yellow motor vehicles of certain seating capacity on state highways prohibited; exceptions; penalty.

It shall be unlawful for any motor vehicle licensed in Virginia having a seating capacity of more than fifteen persons to be operated on the highways of the Commonwealth if it is yellow with the words "School Bus" on the front and rear in letters at least eight inches high and equipped with warning devices prescribed in § 46.2-1090, unless it is used in transporting students who attend public, private, or parochial schools or used in transporting the elderly or mentally or physically handicapped persons.

Any violation of this section shall constitute a Class 1 misdemeanor.
