AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 3.1-796.94:1 and to repeal Article 4.1:1 (§§ 3.1-763.5:1 through 3.1-763.5:8) of Chapter 27 of Title 3.1 of the Code of Virginia, relating to shooting preserves and enclosures.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 3.1-796.94:1 as follows:

§ 3.1-796.94:1. Prohibition on shooting animals other than game animals.

It is unlawful for any person to shoot, attempt to shoot, or take on a shooting preserve, or in a fenced area open commercially to the public where animals are confined for the purpose of being shot, any animal or bird that is not authorized or approved for use on a shooting preserve by the Board of Game and Inland Fisheries pursuant to Chapter 6 (§ 29.1-600 et seq.) of Title 29.1. Nothing in this section shall prohibit the taking of game animals and game birds during authorized open seasons. The provisions of this section shall be enforced by local law-enforcement officers.

A violation of this section is a Class 2 misdemeanor.

2. That Article 4.1:1 (§§ 3.1-763.5:1 through 3.1-763.5:8) of Chapter 27 of Title 3.1 of the Code of Virginia is repealed.

3. That the provisions of this act shall become effective on January 1, 2001.
