1997 SESSION
Be it enacted by the General Assembly of Virginia:
1. That § 2.7:1 of Chapter 209 of the Acts of Assembly of 1968 is amended and reenacted as follows:
§ 2.7:1. Ineligibility of the mayor and council members to hold other office.
No person now a member of council, and no person hereafter elected as
mayor or a member of council, shall, during the tenure of the office as mayor
or councilman, or for one year thereafter, be eligible for any office to be
filled by council by election or appointment; provided that a member of
council, a former member of council or a former mayor may be appointed to a
vacancy in the office of mayor.
No member of city council, including the mayor, shall be eligible during his or her term of office as such member to hold any office to be filled by the council, by election or by appointment, except that the mayor and other members of city council may be named as a member of such other boards, commissions, and bodies as may be permitted by general law; provided, however, that a member of the city council may be elected or appointed to fill a vacancy in the office of mayor.
