1997 SESSION
Whereas, Wesley T. Ingram, Coy P. Goad, Jr., Sonny O. Quesinberry, Trent Goad, M. Wayne Goff, Chester E. Janney, P.P.L. Therapeutics, Inc., Mike Kinzie, Junior Ray Harris, Thomas Raymond Buchanan, and Charles C. Clark are, or have from time to time been, the owners of cattle in Floyd County; and
Whereas, in April 1994, the State Veterinarian, on behalf of the Virginia Department of Agriculture and Consumer Services, and the Area Veterinarian in charge, on behalf of the U.S. Department of Agriculture, notified Allen Harman, C. W. Harman, Douglas Lane Belcher, and Ava B. Belcher that they had reason to believe that cattle in their herds had contracted tuberculosis and needed to be destroyed; and
Whereas, this body provided relief last year to Allen Harman, C. W. Harman, Douglas Lane Belcher, and Ava B. Belcher for losses suffered in connection with having their herds destroyed in cooperation with the State Veterinarian; and
Whereas, Wesley T. Ingram, Coy P. Goad, Jr., Sonny O. Quesinberry, Trent Goad, M. Wayne Goff, Chester E. Janney, P.P.L. Therapeutics, Inc., Mike Kinzie, Junior Ray Harris, Thomas Raymond Buchanan, and Charles C. Clark have also agreed to destroy cattle for the same reasons, the belief that the cattle had contracted tuberculosis, at the request of the State Veterinarian; and
Whereas, Wesley T. Ingram, Coy P. Goad, Jr., Sonny O. Quesinberry, Trent Goad, M. Wayne Goff, Chester E. Janney, P.P.L. Therapeutics, Inc., Mike Kinzie, Junior Ray Harris, Thomas Raymond Buchanan, and Charles C. Clark each had an appraisal of the condemned cattle conducted in accordance with the provisions of § 3.1-750 of the Code of Virginia to establish the fair cash value of the destroyed cattle; and
Whereas, the U.S. Department of Agriculture paid indemnities to Wesley T. Ingram, Coy P. Goad, Jr., Sonny O. Quesinberry, Trent Goad, M. Wayne Goff, Chester E. Janney, P.P.L. Therapeutics, Inc., Mike Kinzie, Junior Ray Harris, Thomas Raymond Buchanan, and Charles C. Clark, but each of these indemnities was less than the fair market value of the cattle destroyed; and
Whereas, Wesley T. Ingram, Coy P. Goad, Jr., Sonny O. Quesinberry, Trent Goad, M. Wayne Goff, Chester E. Janney, P.P.L. Therapeutics, Inc., Mike Kinzie, Junior Ray Harris, Thomas Raymond Buchanan, and Charles C. Clark have no other means to obtain relief except by action of this body; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. § 1. That there is hereby appropriated from the general fund of the state treasury the sum of $776.67 for the relief of Wesley T. Ingram, the sum of $585.67 for the relief of Coy P. Goad, Jr., the sum of $2,281.24 for the relief of Sonny O. Quesinberry, the sum of $211.33 for the relief of Trent Goad, the sum of $436.92 for the relief of M. Wayne Goff, the sum of $512.80 for the relief of Chester E. Janney, the sum of $1,351.13 for the relief of P.P.L. Therapeutics, Inc., the sum of $214.00 for the relief of Mike Kinzie, the sum of $1,606.60 for the relief of Junior Ray Harris, the sum of $238.50 for the relief of Thomas Raymond Buchanan, and the sum of $128.33 for the relief of Charles C. Clark. These sums shall be paid by checks issued by the State Treasurer on warrants issued by the Comptroller, upon execution by Wesley T. Ingram, Coy P. Goad, Jr., Sonny O. Quesinberry, Trent Goad, M. Wayne Goff, Chester E. Janney, P.P.L. Therapeutics, Inc., Mike Kinzie, Junior Ray Harris, Thomas Raymond Buchanan, and Charles C. Clark of a release of all claims they may have against the Commonwealth or any of its political subdivisions or their officers, employees, or agents.
