1997 SESSION
Be it enacted by the General Assembly of Virginia:
1. That § 8.01-452.1 of the Code of Virginia is amended and reenacted as follows:
§ 8.01-452.1. Disposal of exhibits in civil cases.
A clerk of court may, after ninety days from the date in which to
note an appeal has elapsed in a civil case or, if the civil case is appealed or
notice of appeal is pending, when the appeal is concluded, dispose of or donate
any exhibits filed in the case and in his possession after notifying the owner
or his attorney by certified mail, return receipt requested, and after
twenty-one days from the receipt of the notice by the owner or attorney unless
the owner or attorney requests the return of the exhibits.
