CHAPTER 125 An Act to amend the Code of Virginia by adding sections numbered 53.1-32.01 and 53.1-133.01:1, relating to inmate payment for bodily injury to another. [H 1609] Approved March 6, 1997

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 53.1-32.01 and 53.1-133.01:1 as follows:

§ 53.1-32.01. Payment for bodily injury.

The Board is authorized to establish administrative procedures for recovering from an inmate the cost for medical treatment of a bodily injury that is inflicted intentionally on any person by the inmate. Such administrative procedures shall ensure that the inmate is afforded due process.

§ 53.1-133.01:1. Payment for bodily injury.

Each jail superintendent or sheriff who operates a correctional facility is authorized to establish administrative procedures according to regulations promulgated by the Board for recovering from an inmate the cost for medical treatment of a physical injury that is inflicted intentionally on any person by the inmate. Such administrative procedures shall ensure that the inmate is afforded due process.
