SUMMARY:

Study; Medicaid. Requests the Department of Medical Assistance Services to examine existing and available waivers or other options to provide personal assistance services through a consumer-based model of service delivery. The Department must, in its examination, identify and evaluate, insofar as possible, the problems and issues associated with the implementation of consumer-directed models of service delivery, such as, but not limited to, other states' experiences; cost-effectiveness and the potential for cost increases; liability concerns, including the potential for litigation; tax administration considerations; insurance responsibilities, including unemployment compensation and worker's compensation; the qualifications of the attendants, including training, accountability, and whether and which relatives could be hired by the consumer; and the characteristics of eligible recipients who might be offered any future options for consumer-directed services, including whether the caretakers of any eligible children could be authorized to hire and direct any attendants. The Department will report its findings and recommendations to the Senate Committees on Education and Health and Finance by November 1, 1996, and will also submit its findings and recommendations to the Governor and the 1997 Session of the General Assembly.
