SUMMARY:
Medical College of Virginia Hospitals Authority. Transfers the operations, employees, and obligations of the Medical College of Virginia Hospitals (MCV) to the Medical College of Virginia Hospitals Authority, a newly created political subdivision of the Commonwealth. The transfer is to occur no later than June 30, 1997. The Authority is to assume the obligations of MCV as well as the missions of operating the MCV Hospitals as teaching hospitals for the benefit of the Schools of the Health Sciences Division of Virginia Commonwealth University, providing high quality patient care and providing a site for medical and biomedical research, in close affiliation with the Health Sciences Division of VCU to avoid duplication of or competition with VCU, the undergraduate and graduate programs, research, training and teaching facilities.
Current MCV employees may opt to maintain their participation in the Virginia Retirement System or may participate in an alternative benefits plan offered by the Authority. Employees not selected for transfer from state employment to Authority employment may be entitled to the benefits of the Workforce Transition Act of 1995. Employees shall be considered state employees until July 1, 2001. The Authority is exempt from the Virginia Personnel Act, the Virginia Public Procurement Act, and the Administrative Process Act.
The Authority must report to the Senate Finance and House Appropriations Committees prior to undertaking a capital project with a cost exceeding $5 million, and may not proceed with the project if a committee objects.
Governed by a 16-member board of directors comprised of gubernatorial, legislative, and VCU appointees and two ex officio members, the Authority is empowered to issue bonds; to acquire property by right of eminent domain; to create nonprofit corporations; to enter into joint ventures; and to make rules and regulations governing hospital operations, including practice privileges, admission and treatment of patients, procedures for determining the qualification of patients for indigent care or other programs, and protection of patients and employees. The Authority is exempt from state property and sales taxes.
