SUMMARY:
Nursing facilities; special education. Revises the licensure and funding requirements for pediatric units of nursing facilities. School divisions placing a child in a nursing facility will have their local share deducted by the Department of Education; any amount above this sum which the educating school division incurs will be billed to the state. The bill also provides that the cost of public special education provided to children who are residents of the Commonwealth and living in a nursing facility which has received a child-caring institution license shall be billed to the sending agency or person, if the placement was not made by a school division. These children are medically fragile and, in many cases, severely handicapped children. Frequently, the nursing home placements are made because of Medicaid eligibility.
