SUMMARY:

Unemployment compensation; disqualification. Disqualifies an individual from receiving unemployment compensation benefits during any week that the individual, in connection with an offer of suitable work, tests positive for a nonprescribed controlled substance if the test is (i) required as a condition of employment and (ii) performed, and a sample is collected, in accordance with scientifically recognized standards by a laboratory accredited by the National Institute of Drug Abuse. Under the bill, the disqualification begins with the week in which the test was conducted and continues until the individual has worked for an employer for 30 days and subsequently becomes separated from such employment.
