SUMMARY:
Workers' compensation; occupational disease presumption. Adds to the class of employees covered under the occupational disease presumption set forth in subsection B of § 65.2-402. The bill adds employees with supervisory or custodial responsibility with respect to persons confined in secured facilities or detention homes operated by or under contract with the Department of Youth and Family Services to such class of employees. The presumption in current law provides that, unless overcome by a preponderance of competent evidence to the contrary, disability or death from heart disease or hypertension is an occupational disease, covered by the Workers' Compensation Act.
