SUMMARY:

Judicial sale of property. Streamlines the judicial sale process for delinquent taxes on certain property: (i) allows more time for clerks to transmit copies of the court order of publication to designated newspapers (20 days rather than 10 days from order) and clarifies that notice of judicial sale will be mailed to the property owner and published in the newspaper at least 30 days prior to commencement of any judicial proceeding; (ii) reduces the amount of time that a person with an interest in the property has to file a claim to 30 days, from 90 days, after notice of judicial proceedings and clarifies that these persons need not be parties to the proceeding; (iii) allows attorneys' fees to be collected upon redemption by the owner; (iv) clarifies the ability of a locality to proceed with judicial sale of a property if the owner fails to meet the terms of an installment agreement upon fifteen days' written notice; and (v) establishes that upon completion of the judicial sale process, title is conveyed free of all claims of persons with an interest in the property provided that they were given notice and made a party defendant.
