SUMMARY:
Jury sentencing. Requires the court in a felony case, if either the Commonwealth or the defendant so request, to inform the jury that parole has been abolished and that the defendant is required by law to serve at least 85 percent of any term of incarceration imposed. The bill does not set out the actual language to be used in a jury instruction. The Judicial Conference is directed to promulgate jury instructions reflecting the changes in parole eligibility. This bill is recommended by the Virginia Sentencing Commission.
