SUMMARY:
Medicaid; fraudulently issued benefits; civil action to recover costs. Clarifies the Department of Medical Assistance Services' authorization to pursue civil action against individuals who obtain Medicaid benefits by allowing recovery of all fraudulently issued benefits and granting the Attorney General the discretion of going forward, independent of any referral to or criminal action brought by the attorney for the Commonwealth, with a civil action to recover these costs and to petition for civil penalties. Presently, the statutory authority to pursue actions against third parties is ambiguous because the liability relates to any excess benefits received rather than any fraudulently issued benefits.
