SUMMARY:
Habitual offenders; show cause proceedings. Eliminates statutory language which requires a court to wait until conviction before reviewing a defendant's driving record to determine whether an order should be issued requiring the defendant to appear and show cause why he should not be declared an habitual offender. The bill requires the court to check the record upon disposition, whether guilty or innocent, and to send notice of a pending adjudication to DMV rather than an abstract of conviction.
