SUMMARY:
Constitutional amendment (voter referendum); rights of victims of crime. Provides for a referendum at the November 5, 1996, election on a proposed addition to the Virginia Bill of Rights to accord to victims of crime certain rights as may be defined and provided by law by the General Assembly. The amendment provides that victims of crime should be afforded fair and respectful treatment by public officers and employees, restitution for harm, protection from further harm, information on relevant judicial proceedings and on the release and escape of the offender, and the opportunity for meaningful participation in the criminal justice process. The provision also states that any rights which may be created do not confer a right to appeal or to modify decisions in criminal proceedings and do not create any cause of action against the Commonwealth, political subdivisions, or public officers or employees.
