SUMMARY:

Public utilities; special rates; alternative forms of regulation. Authorizes the State Corporation Commission to approve, either in the context of or apart from a rate proceeding after notice to all affected parties and hearing, special rates, contracts or incentives to individual public utility customers or classes of customers where it finds such measures to be in the public interest. Under the bill's provisions, the SCC, after notice and public hearing, is required to issue guidelines for such special rates which ensure that other electric utility customers are not caused to bear increased rates as a result of the special rates. The bill also authorizes the SCC to approve alternative forms of regulation for electric companies, including the use of price regulation, ranges of authorized returns, categories of services and price indexing. Under the bill, the SCC must, before approving special rates, contracts or incentives, or other alternative regulatory plans, ensure that such action (i) protects the public interest, (ii) will not unreasonably prejudice or disadvantage any customer class and (iii) will not jeopardize the continuation of reliable electric service.
