SUMMARY:

Abolition of required indictment. Eliminates the requirement that a person accused of a felony be indicted by a grand jury before trial. The bill would allow the accused to be tried without an indictment, provided that probable cause had been found at a preliminary hearing or the accused had waived both the preliminary hearing and indictment. Failure to find probable cause at a preliminary hearing does not bar a subsequent indictment or presentment.
