SB 133 Charitable Gaming Commission.

SUMMARY:

Charitable Gaming Commission; penalty. Makes it a Class 6 felony for knowingly making a false application or report to the Commission, and (i) adds the definition of "adjusted gross receipt" and "management, operation, or conduct," (ii) requires the Commission to conduct a background investigation on all Commission employees and applicants for permits and licenses, (iii) authorizes the Tax Commissioner to provide tax information to the Commission necessary to identify those permit and license holders who have not filed required returns or who owe delinquent taxes, (iv) authorizes the Commission to define a limit for reasonable rent paid by a charity for lease of bingo halls, (v) provides that no person under the age of 18 years shall play bingo or participate in its management or operation, and (vi) extends the Commission's exemption from the APA from 12 months to 24 months for the adoption of regulations, provided that rules and regulations are adopted after a public hearing held after 30 days' notice. The bill contains an emergency clause for one section (18.2-340.38) and also has several technical amendments.
