SUMMARY:
Service of process. Eliminates eligibility language relating to persons who may serve process to clarify that the persons listed may serve process without first obtaining authorization from the court. The bill also clarifies that when the words "officer" and "sheriff" are used with reference to service of process throughout the Code, they are to include all persons authorized to serve process. There is an old Attorney General's opinion which construes the eligibility language to require the courts to exercise discretion over who may serve process, even if the statutory criteria are met.
