SUMMARY:

Programs for voluntary, random testing for controlled substance and alcohol use by students participating in interscholastic athletics. Requires the Board of Education, in consultation with the Office of the Attorney General, to promulgate regulations governing programs for random testing for controlled substance and alcohol use by students participating in interscholastic athletics. Local school boards may then approve the implementation of a random testing program for student athletes in the school division pursuant to these regulations. The costs of the program shall be borne from fees paid by participating students and from other funds that may be appropriated or received for this purpose. No state or local basic aid funds shall be expended on these programs. Individual test results are disclosed to the student, his parents, the division superintendent, and certain school administrators. The Board shall promulgate regulations pursuant to the Administrative Process Act, including certain provisions addressing student and parental consent for program participation; limited disclosure and confidentiality of test results; agreements between participating schools and companies providing testing, analysis, and data compilation services; and provisions of relevant state, federal, and constitutional laws.
