SUMMARY:
Expert testimony in criminal cases. Incorporates the civil (statutory) rule into criminal practice that an expert can offer an opinion based on external information if it is of the kind typically relied upon by experts in the field and if the jury is informed of the nature but not the contents of the external information. This was the apparent rule in criminal practice (by case law) until the civil rule was enacted and, because the civil rule was not specifically made applicable (by statute) to criminal practice, it was deemed inapplicable to criminal practice by the Supreme Court. The current situation is one of confusion and erratic application of the rule.
