SUMMARY:
Testimony of husband and wife in criminal cases. Removes the requirement that a spouse seek the other spouse's consent to testify against that spouse by transferring the privilege from the accused spouse to the testifying spouse. The bill preserves other exceptions to the spousal privilege in cases of offenses by one spouse against the other, against a minor child of either, and forgery and sexual assault cases.
