SUMMARY:

Accident and sickness insurance; small employer market; preexisting conditions. Credits coverage provided under: (i) Medicare, Medicaid, CHAMPUS, the Indian Health Service Program or any other similar publicly sponsored program, (ii) a group health insurance or health benefit arrangement that provides benefits similar to or exceeding benefits provided under the essential health benefit plan, or (iii) an individual health insurance policy, including coverage issued by a health maintenance organization, health services plan or fraternal benefits society, that provides benefits similar to or exceeding the benefits provided under the essential health benefit plan, when computing the length of a preexisting condition exclusion period under small employer market provisions. Current law limits this period to 12 months.
