SUMMARY:

Emergency Medical Services Patient Protection Act. Establishes the Emergency Medical Services Patient Protection Act. Requires under this bill, licensed physicians must provide medical screening, examination, or treatment to persons upon their request for such care, or transfer such persons to another medical facility if the physician determines that the person has a condition requiring emergency care. Physicians must advise such persons or their representatives of the risks of the medical screening, examination or treatment, of transferring to another medical facility, and of refusing medical care or transfer. In the event of an emergency, the physician must secure proper medical treatment from the nearest appropriate medical facility, and take such care as to stabilize the individual's medical condition prior to transferring them. Physicians who violate the provisions of the act are subject to disciplinary action by the Board of Medicine and to a monetary penalty which may not exceed $5,000 for each violation.
