SUMMARY:

Health insurance; small employer market. Changes from 49 to 99 the maximum number of eligible employees of an employer considered to be a "small employer" for purposes of certain health insurance provisions. Under Virginia law, in the small employer market, insurance carriers are required to (i) not exclude or limit coverage for preexisting conditions of an insured for more than 12 months from the insured's effective date of coverage; (ii) guarantee the renewability of coverage (at the small employer's option); and (iii) not exclude any member of the small employer group.
