SUMMARY:
Evidence admissible at hearing on DUI license suspension. Allows admission into evidence at the administrative license suspension hearing, without verification by the arresting officer, of his report made to the magistrate setting forth the probable cause for a DUI arrest. Currently, some courts will not allow the report as evidence upon a hearsay objection unless the officer is present to verify it. This removes the need for the officer to appear unless subpoenaed.
