SUMMARY:

Workers' compensation; disclosure of claims history. Authorizes employers to require prospective employees to disclose prior claims for workers' compensation benefits--except to the extent such a request would conflict with the Americans with Disabilities Act. Employers may use this information solely to determine whether a prospective employee has previously made fraudulent claims for workers' compensation benefits. Moreover, employers may not reveal claims-related information received to any other person. Any employee who fails to properly disclose information requested pursuant to the provisions of this bill may be denied workers' compensation benefits for any current claims related to previous claims not disclosed.
