SUMMARY:
Medical Assistance Services; authority to impose sanctions and other remedies. Requires, in order to comply with federal law, the Board of Medical Assistance Services to promulgate regulations incorporating sanctions and other remedies established by state law for certified nursing facilities in accordance with the federal regulations (42 CFR 488.400 et seq.). In recent months, several nursing homes caring for substantial numbers of Medicaid patients have experienced serious financial problems, with the potential for endangering the health and safety of the patients, e.g., inability to meet payrolls, payments for necessary food, equipment, supplies, and utilities, and, in one case, failure to maintain workers' compensation insurance. This provision will provide greater protections for patients and their families from possible unsafe or unstable environments or financial conditions.
