SUMMARY:

Penalty of bond of executor or administrator. Creates a mechanism for the reduction of a personal representative's bond by the clerk if it is determined by reference to an accounting or inventory filed with the clerk that the value of the estate has decreased. Currently the Code allows for a later increase in the bond, but does not provide a method for the bond's reduction. These amendments do not apply to bonds set by the court.
