SUMMARY:
Infringement of trademarks; penalties. Expands the current civil infringement statute to specifically cover (i) use of a protected mark in connection with the manufacture or distribution of goods and (ii) application of an unauthorized mark to apparel and other manufactured goods.
The criminal penalty for a second violation is increased to a Class 6 felony. The court's authority to allow destruction of the counterfeit product is made mandatory, but is also expanded to allow for another disposition in lieu of destruction.
