SUMMARY:
Disqualification of attorney for the Commonwealth. Allows for appointment of a full-time attorney for the Commonwealth from another jurisdiction to act whenever an attorney for the Commonwealth is unable to act due to disabililty or conflict. Current law requires the appointment of a private attorney. The bill will allow a private attorney to be appointed by the court if another Commonwealth's attorney is not available, or for other cause and will allow an attorney employed by a state agency to be appointed when to do so would aid in the prosecution of a case.
