SUMMARY:
Alcoholic beverage control; reciprocal interstate sale of wine. Authorizes any out-of-state person or licensee whose state affords a reciprocal shipping privilege to Virginia to ship for personal use and not for resale two cases of wine per year, each case containing no more than nine liters, to Virginia persons of legal age without the imposition of Virginia taxes, fees or charges, provided that the shipper of the wine is not a Virginia licensee. The bill authorizes Virginia persons or licensees to do the same; however, the shipment would constitute a sale in Virginia. The bill requires the shipped container to be clearly labeled to ensure that delivery is not made to (i) a person less than 21 years of age, (ii) an interdicted person or (iii) an intoxicated person. The bill prohibits advertising of such reciprocal agreement in Virginia. Finally, the bill authorizes, upon notification and approval of the ABC Board, an out-of-state winery to furnish American wine it produces and bottles to wine-tasting events in Virginia, provided that such state affords a reciprocal privilege to Virginia wineries.
