SUMMARY:

Unemployment compensation; agricultural employment. Excludes from the provisions of the Virginia Unemployment Compensation Act labor performed by aliens admitted to the United States to perform service in agricultural labor pursuant to 8 U.S.C. § 214 (c) and 8 U.S.C. § 101 (a) (15) (H) of the Immigration and Nationality Act. Under current law, such labor is excluded if performed prior to January 1, 1995. The bill's provisions eliminating this limitation are conditioned upon (i) authorizing legislation by the United States Congress, or (ii) judicial action by the United Supreme Court declaring corresponding limitations in the Federal Unemployment Taxation Act invalid or unconstitutional.

If the bill's provisions become effective, as set forth above, employer unemployment taxes paid for such alien labor will be refunded. The refunds will be retroactive to the effective date of federal legislative or judicial action authorizing the exclusion of such labor from coverage under Virginia's unemployment compensation laws.
