SUMMARY:
Expulsions for weapons offenses; zero tolerance. Clarifies that suspension or expulsion is not required for the possession of an object that is not a destructive device or firearm; that a reasonable person would consider a toy; and that it is not brandished in a threatening or disruptive manner.
Current law requires expulsion of students bringing weapons on school property for 365 days, unless the school board determines another punishment is appropriate. The "zero tolerance" provision was approved during the 1995 Session, reflecting the requirements of the federal Gun-Free Schools Act of 1994, that requires states to have such a statute and to implement "zero tolerance."
