SUMMARY:

Regulation of fertilizers. Establishes a model ordinance which would require a permit for land application of sewage sludge, other than Class 1 sludge which meets regulatory criteria for distribution and marketing, more frequently than once every three years. Localities are authorized to enact the model ordinance in whole or in part, or to regulate application of sewage sludge pursuant to an ordinance existing on February 1, 1996, so long as the existing ordinance does not prohibit land application of sludge. The bill also provides that the manufacture, sale, distribution and use of products governed by the Virginia Fertilizer Act shall be regulated only as provided in the Act, except to the extent that the Code requires any agency to engage in such regulation to protect health, safety or the environment.
