SUMMARY:
Virginia Public Procurement Act; design-build authority. Grants the School Board of Accomack County the authority to renovate two public schools and build four public schools through a contract on a fixed price or not-to-exceed price design-build basis or construction management basis in accordance with procedures consistent for procurement of nonprofessional services through competitive negotiation. More than twenty local government entities have been granted this authority to date. These governing bodies may authorize payment to no more than three responsive bidders who are not awarded the design-build contract if the governing body determines that such payment is necessary to promote competition. Governing bodies are not required to award a design-build contract to the lowest bidder, but may consider price as one factor in evaluating the proposals received. Adequate records must be kept to allow for post-project evaluation by the Commonwealth.
