SUMMARY:

Erosion and sediment control. Allows an owner of property which has sustained damage or which is in imminent danger of being damaged to obtain injunctive relief. However, the bill limits the circumstances under which an injunction can be sought. A person could not seek such relief until (i) he notified in writing both the person who violated the local program and the program authority that damage to his property has or may occur and (ii) the person and program authority notified have not taken action within 15 days to correct the problem. Currently, only the local permit-issuing authority or program authority, or the Virginia Soil an Water Conservation Board, may attempt to have violations of an erosion and sediment control program or permit enjoined.
