SUMMARY:

Sale of tobacco products to minors; identification; fine. Prohibits sale of tobacco products to a person who does not produce a governmentally issued photo identification establishing that the person is at least 18, unless the seller knows or has reason to believe that the person is at least 18. General appearance, facial characteristics, behavior and mannerisms of the purchaser may be considered by the trier of fact in assessing whether the seller had reason to believe that the purchaser was 18 or older. Sale in violation of these provisions is made punishable by the same civil penalty as is currently authorized for unlawful sale ( maximum of $50 for first offense; $100 for second offense).

An exception is provided for mail-order sales.
