SUMMARY:

Agricultural practices and water quality. Authorizes the Director of the Department of Conservation and Recreation to notify a person conducting an agricultural activity that his operation is not in conformity with best management measures as they are defined in the bill. If the Director determines that a problem exists, the landowner has six months to begin to implement a site-specific conservation plan to correct any pollution. If the landowner fails to begin to implement a plan, the Director is empowered to issue a corrective order which can be issued only after the landowner has a hearing. The landowner has the right to appeal such an order. A violation of this law could result in the landowner or operator being assessed a civil penalty of up $5,000. The fines collected would be placed into a special fund to be used for monitoring the effects of agricultural practices on water quality and for education activities promoting water quality.
