SUMMARY:

Appeals of agency action. Establishes a new, consistent standard for challenging decisions of the waste, water and air boards, which includes specific criteria based on a U.S. Supreme Court decision. However, the new standards are not effective "unless and until" an unappealable court decision declares that Virginia's current air permit standing requirement does not meet the requirements for state program approval under Title V of the federal Clean Air Act. Until such a court decision is rendered, an "interim" standing provision for appeals of Water Board decisions, which is identical to the standard found in Virginia's waste law, is created.
