SUMMARY:
Subrogation of medical payments. Amends "payor of last resort" statute to provide actions for damages brought by the Department of Medical Assistance Services against third parties who are not insurers, health services plans or health maintenance organizations are to be decided under the same laws, rules and standards that would apply if the individual receiving services had brought the action directly. The bill clarifies that in such a case the doctrine of sovereign immunity would apply.
