SUMMARY:

Motor vehicle insurance; uninsured motorist insurance coverage. Establishes procedures for shifting defense costs from an underinsured motorist's (operator) liability insurance carrier to the claimant's carrier for underinsurance coverage. Defense costs may be shifted under this bill whenever the operator's carrier (i) tenders the policy's coverage limits to the claimant and (ii) solicits payment of a proportionate share of the defense costs from the underinsurance carrier. If the underinsurance carrier refuses to pay a proportionate share of the defense costs within 60 days of the demand therefor and a judgment is subsequently entered against the operator for an amount exceeding the policy limits previously tendered, the operator's carrier may recover such defense
