SUMMARY:

Certificate of public need; moratorium; exception. Modifies the exception granted during the 1995 Session for a facility located in Henrico County. Although the public perception is that an exception to the moratorium means the granting of the COPN, this is not the legal effect of the exception. Each entry provides an exception to the moratorium on the acceptance of applications for nursing facility projects that propose to increase the number of beds in which licensed nursing facility or extended care services are rendered for specific facilities. This facility's 1995 exception required the new nursing facility beds to be retained for use with private-pay patients. This amendment notes the presence of a 32-unit adult care residence in the same facility and that the new nursing facility beds will be prioritized for patients from these units, but will not be retained exclusively for these patients. Further, subject to determination by the Commissioner, the new nursing facility beds will be retained as private-pay beds or shall, as a condition for granting the certificate, be certified for use by Medicaid patients. This bill has an emergency clause and will go into effect on signing by the Governor. A third enactment will cause this provision, except for the enactment itself, to expire of July 1, 1996, unless the moratorium is continued. The Commissioner is charged with processing the applications filed under the exceptions that are presently in effect and must complete this process by December 31, 1996.
