SUMMARY:
Dismissal of action by nonsuit. Provides that if a nonsuit is taken at any time after the plaintiff has rested its case in chief or if a second or additional nonsuit is allowed, the court may assess costs and reasonable attorney's fees against the nonsuiting party. Under current law the court may assess costs and fees only upon a second or subsequent nonsuit.
