SUMMARY:

Remedy for arbitrary refusal of a motor vehicle insurance claim. Eliminates the distinction between the bad faith failure to pay small claims and large claims by a motor vehicle insurer. A jury is allowed to be the trier of fact, which currently is prohibited. Interest accumulates on the claim at the legal rate of interest from the date of the claim.
